TERMS AND CONDITIONS FOR TOPPARKEN RAD VAN FORTUIN (promotional game of chance)
These terms and conditions apply to the 'TopParken Wheel of Fortune' (hereinafter: 'the Wheel'), which is organised by TopParken Holding BV, with its registered office in Lunteren at Immenweg 15, and registered with the Chamber of Commerce under number 09147886, hereinafter: 'TopParken'.
Article 1 General terms and conditions of play
1. Every person who has received a scratch card at check-out and with a minimum age of 18 years is entitled to participate in the Wheel. The consent of a legal representative is required for participation by persons under 18 years of age.
2. Participation in the Wheel is free of charge, with the exception of charges for the use of (mobile) data.
3. These action conditions can be found online at topparken.nl/vakantierad/actievoorwaarden
4. Employees of TopParken, holiday home owners at TopParken and third parties engaged by TopParken are excluded from participation.
5. Only one prize will be awarded per family living at the same address.
6. Prizes won with the Wheel are not valid in combination with other actions by TopParken and its partners, including discount actions.
7. Only participants who have participated correctly and in accordance with the campaign conditions in the campaign period and whose participation is linked to a prize, are entitled to the aforementioned prize.
8. All prizes are personal and therefore not transferable. Prizes are not exchangeable for money and in the event of refusal (or for any other reason of non-award) of a prize, it will revert to TopParken.
9. If gambling tax has to be paid on the prizes distributed, TopParken will pay this tax.
10. Participants in the wheel will always receive a '20% Vakantierad discount' at TopParken.
*The discount code applies over the rental price of a booking with a maximum stay of 28 nights, made via our website. The discount is valid at all TopParken holiday parks, in all periods and for all accommodation. The discount is not valid in combination with other offers and/or discounts.
Article 2 How and when can you participate?
1. Holiday guests receive a unique code at check-out, with which they can participate in the Wheel. The unique code can be entered on the action page: www.topparken.nl/vakantierad. Participation requires agreement to the action terms and conditions.
2. One unique code will be issued per booking.
3. The code must be completed in one go.
4. The Wheel runs from 1 October 2024 to 31 December 2024.
Article 3 Prizes
1. The participant in the Wheel has a chance to win the following prizes:
- 1x A 49'' LG SmartTV UHD 4K worth €455.
- 1x NEO Tools tool cart with 7 drawers, including 129 tools worth € 995.
- 2x 2 admission tickets for André Rieu on 11 January 2025 worth € 223.45.
- 1x Apple AirPods 2 with charging case worth € 159.
- 10x Coolblue gift voucher worth € 50.
- 4x 4 Gourmet menus for free worth € 21.95.
- 2x TopParken Holiday Cashback worth € 449.
Cash prizes up to and including € 449,- are tax-free. Above that, all cash prizes are taxed with 30,1% gambling tax. This will be paid by TopParken Holding B.V..
2. Only participants who have participated in the Wheel in the campaign period in the correct manner and in accordance with the campaign conditions and whose participation is linked to a prize are entitled to that prize.
3. The prize can be collected until 31-3-2025. After this date, the prize won will be forfeited, with the exception of a 20% Vakantierad discount.
Article 4 Designation of winners
1. The winners of the Wheel and the prizes linked to it will be determined and distributed randomly and impartially.
2. Within 48 hours, winners will receive a personal message from TopParken via the e-mail address provided, containing information about collecting their prize. Participants who have not won a prize will not be notified separately.
3. No correspondence can be entered into about the outcome of the Wheel.
4. If a winner cannot be reached, or does not respond within three weeks to a request from TopParken regarding the collection of the prize, he/she will no longer be able to claim the prize won.
Article 5 Liability and indemnity
1. By accepting these terms and conditions, the participant acknowledges that participation in the Wheel is entirely at his/her own risk.
2. TopParken is not liable for any damage, of whatever nature, arising from or related to participation in the Wheel. Printing, spelling, typesetting or similar errors cannot be held against TopParken by the participant and cannot in any way create an obligation for TopParken. TopParken is not responsible or liable for costs incurred by the participant in connection with participation in the Wheel.
Article 6 Copyrights and co-operation
1. The winner who lends his/her co-operation to promotional activities of TopParken shall not thereby be entitled to financial compensation.
2. It is not allowed to reproduce the software, the website or the contents of the Wheel, in whole or in part, in any form whatsoever, without the written consent of TopParken.
Article 7 Personal data
1. Participation in the Wheel requires certain personal data, namely e-mail address, salutation, surname and country of origin.
Personal data will be used for awarding prizes to winners of the Wheel. 2. By participating in the Wheel, the participant consents to the use of his or her personal data for at least one commercial mailing. An unsubscribe link will be included in this commercial mailing if no follow-up mailings are desired.
Article 8 Rights of TopParken
1. TopParken reserves the right to terminate your participation in the Wheel at any time if you contravene these terms and conditions or any legally applicable provision in any way, without notifying you in advance, without giving any reason, at its own discretion and without TopParken being held liable.
2. TopParken reserves the right, at its sole discretion and without prior notice, to terminate, interrupt or modify the Wheel and/or change the prices of the Wheel if circumstances so require.
3. In all cases not provided for in these terms and conditions, TopParken shall decide.
Article 9 Applicable law
Dutch law applies to this competition, and any disputes in relation to the competition which cannot be resolved by mutual agreement will be submitted to the competent courts in Amsterdam.

If your complaint has not been dealt with to your satisfaction and you believe that the Rad does not comply with the Promotional Games of Chance Code of Conduct 2014, you may submit a written complaint to De Kansspelautoriteit, PO Box 298, 2501 CG The Hague, Tel: 070- 302 1300.
